Italian citizenship by        Wedding

If the marriage took place before 04/26/1983 the  Italian citizenship  wife's is automatic, recognized along with yours.  If the wedding was  after that date, after 3 years from the date of marriage, you can apply for Italian citizenship by marriage, called naturalization.  Citizenship by naturalization  can be requested  also for the spouse  ( husband )  and does not imply loss of Brazilian citizenship in any of the cases. As we received many questions on the topic, we summarized it below:

1) Can my spouse acquire Italian citizenship through marriage?

A: Citizenship by Marriage or Naturalization, in legal terms, can be required by both men and women.

 

2) After how long of marriage is it possible to file an application  ?

A: It may be required if the applicant resides for 2 years legally in Italy or 3 (three) years outside Italy.

 

3) Are the rights and duties the same?

A: Yes, like any citizen of any country.

 

4) If I become naturalized, I lose my nationality  Brazilian ?

A: Brazilian citizenship is only lost in cases of formal resignation by means of a letter addressed to a consular authority or according to our Constitution, if  has his naturalization canceled, by court decision, due to activity harmful to the national interest.

 

 

5) How long does it take to complete the  naturalization process ?

A: Regardless of where the request is made, either via the Italian Consulate in any country or directly in Italy, the completion time is an average of two years, after the request is filed, and may occur earlier if you have minor children.

 

6) Does the stable union give the right to naturalization?

A: Italy does not recognize a type of stable union, nor homoaffective relationships.

Notes: Italian Citizenship or Naturalization is a concession, normally not denied if documentation is in order, marriage is proven in fact  and have no criminal record.
